This Program Agreement (“Agreement”) is between Holistic Movement / Debra L. Korn, ND (“Practitioner,” “we,” “us”) and the undersigned client (“Client,” “you”). By paying any fee, clicking “I agree,” signing below, or accessing Program materials, you accept these terms.

1. The Program

The 16-Week Root-Cause Healing Protocol is a private, educational, and consultative wellness program. It may include:

An individualized protocol plan based on your history, labs (if provided), and goals.

Scheduled TeleMed / virtual or phone consults during the 16-week period.

Written or digital protocol materials, nutrition and lifestyle guidance, and check-in support as described at enrollment.

Recommendations regarding food, hydration, movement, rest, and third-party products you may purchase separately.

The exact consult schedule and materials will be confirmed in your welcome packet or enrollment invoice. The Program begins on the Start Date listed below (or the date access is first granted, whichever is earlier) and runs sixteen (16) consecutive weeks unless we agree in writing to pause or extend.

2. Nature of Services — Important Legal Disclaimer

Holistic Movement provides naturopathic, functional, and educational support. This is not a hospital, emergency service, or conventional medical practice.

The Program is not a substitute for care by your licensed physician, oncologist, or other treating providers.

Nothing in the Program diagnoses, treats, cures, or prevents any disease under New York or federal law.

You remain responsible for all medical decisions, prescriptions, imaging, and emergency care.

If you have cancer, autoimmune disease, diabetes, or any serious condition, you agree to keep your licensed medical team informed and to seek emergency care for urgent symptoms.

Results vary. No specific outcome, lab change, remission, or timeline is promised or guaranteed.

You acknowledge that you are purchasing coaching, education, and a structured protocol — not a guaranteed medical result.

3. Fees, Billing, and What You Are Buying

The Program fee is a prepaid package fee for the full 16-week protocol, not a week-by-week subscription, unless a written payment plan says otherwise.

The fee is earned when (a) this Agreement is accepted and (b) Program access or materials are first delivered or the first consult is held — whichever occurs first.

Payment plans, if offered, are for convenience only. Missing a payment may pause support until the account is current.

Third-party products (supplements, labs, devices, shipping) are separate purchases and are not included unless listed on your invoice.

The name that will appear on your card or bank statement will identify Holistic Movement or a closely related descriptor. Keep this Agreement so you and your family can recognize the charge.

All fees are in U.S. dollars. You authorize the payment method you provide for the Program fee and any agreed add-on charges.

4. Refunds, Cancellation, and Chargebacks

Because digital materials, consult time, and protocol design are delivered at the start of the Program:

There is no cooling-off refund after Program access or materials have been delivered, except as required by law or as stated in this Section.

If you cancel in writing before any materials are delivered and before the first consult, we will refund amounts paid minus a reasonable administrative fee not to exceed $75.

After delivery or the first consult, fees are non-refundable, except for a limited death/incapacity proration described in Section 5.

Dissatisfaction with results, change of mind, family disagreement, or choosing a different provider is not grounds for a refund or chargeback.

You agree to contact Holistic Movement first at 631-255-5003 or debra@holisticmovement.us about any billing question. A chargeback is not a substitute for that process. If you or anyone acting for you files a chargeback after services or materials were delivered, you agree that we may submit this Agreement, receipts, emails, login or delivery records, and consult notes (as permitted) as evidence that the charge was authorized and the Program was provided.

5. Death, Incapacity, or Inability to Continue

If the Client dies or becomes legally incapacitated during the 16 weeks:

Already-delivered consults, protocol design, and digital or shipped materials are fully earned and not refundable.

Upon written request from the court-appointed executor, administrator, or legally authorized representative, together with a death certificate (or comparable proof) and proof of authority, Holistic Movement may, at its discretion, refund a prorated portion of the unused remaining weeks only. Proration is calculated as: unused full weeks ÷ 16 × Program fee, less the value of materials already delivered (which we may treat as earned in full).

A relative, adult child, or other family member who is not the legal representative of the estate is not entitled to demand a refund or to reverse the charge through the bank.

No refund is due if the Client used the Program, confirmed receipt of materials, or completed consults covering the period in question.

This Section exists so families have a clear, humane process without using a credit-card dispute as a refund department.

6. Client Responsibilities

You agree to:

Provide honest health history and keep us updated on medications, treatments, and new diagnoses.

Attend scheduled consults or give at least 24 hours’ notice to reschedule (missed consults may be forfeited).

Implement only what you and your licensed medical providers agree is appropriate for you.

Not share Program materials with others or resell the protocol.

Maintain your own physician relationship for labs, prescriptions, and emergencies.

7. Communications and Records

Support is provided by email, phone, text, or video as we arrange. We are not an emergency line. For chest pain, breathing trouble, severe bleeding, suicidal thoughts, or any emergency, call 911 or go to the nearest emergency department.

You consent to receive Program emails, receipts, and appointment reminders at the address you provide. Those emails are proof of delivery of digital materials and notices.

8. Intellectual Property

All protocols, handouts, videos, emails, and teaching materials remain the property of Holistic Movement. You receive a personal, non-transferable license to use them for your own health during and after the Program. You may not copy them for other patients, post them publicly, or use them to run a competing program.

9. Limitation of Liability

To the fullest extent allowed by law, Holistic Movement and Debra L. Korn, ND are not liable for indirect, incidental, or consequential damages, or for outcomes that depend on your medical condition, adherence, or other providers’ care. Our total liability for any claim arising from the Program is limited to the Program fee you actually paid for the then-current 16-week term. This limit does not apply to liability that the law does not allow us to limit.

10. Privacy

We treat your health information as confidential and use it to deliver the Program. Virtual care is not 100% risk-free. Do not send information through unsecured channels if you are not comfortable doing so. If a Business Associate or HIPAA notice applies to a particular service, it will be provided separately.

11. Governing Law

This Agreement is governed by the laws of the State of New York, without regard to conflict-of-law rules. Exclusive venue is the state or federal courts sitting in Suffolk County, New York, unless a different forum is required by law. If any clause is unenforceable, the rest remains in effect.

12. Entire Agreement

This is the entire agreement about the 16-Week Protocol. It replaces prior oral promises about refunds or results. Changes must be in a signed writing (email confirmation from both parties is enough).

13. Acknowledgment

By signing or checking “I agree,” you confirm that you have read this Agreement, you understand the Program is educational and consultative, fees are earned as described, chargebacks are not a refund method after delivery, and death or family requests follow Section 5.
